June 25, 2020 — A Texas appellate court has ruled that a drilling company in Louisiana will not have to face a lawsuit from a man who was injured on an oil rig, according to Law360.
The $1 million injury lawsuit was filed against Baywater Drilling LLC by Benjamin R., a man who suffered severe neck and back injuries on the job.
He said he was required to manually lift objects that weighed more than 300-pounds on Bayou Blue, an inland oil rig in Louisiana.
His lawyers argued that Texas courts should have jurisdiction over the lawsuit because the oil rig was operating under a contract with Texas-based Hilcorp Energy Co.
However, the First Court of Appeals of Texas ruled that Baywater Drilling did not have sufficient ties to Texas to be sued in the state.
Hilcorp Energy and Baywater Drilling are accused of violating regulations and failing to provide adequate crew or necessary safety equipment to perform the task.
The case is Baywater Drilling LLC v. Benjamin Ratliff — Case Number 01-19-00706-CV in the First Court of Appeals of Texas.
