Baby Powder Cancer Lawsuit Ends in $18.8 Million Jury Award

July 21, 2023 — A young man who is terminally ill with mesothelioma has been awarded $18.8 million by a jury who found that his cancer was caused by Johnson’s Baby Powder.

The plaintiff, 24-year-old Emory Hernandez Valadez, was diagnosed with a rare type of mesothelioma in 2022.

In his lawsuit against Johnson & Johnson, He claims that he developed aggressive cancer around his heart after being exposed to asbestos in Johnson’s Baby Powder as a child.

During a 6-week trial in California, his lawyers showed the jury photos of him as a child alongside bottles of Johnson’s Baby Powder.

He claims that his mother used the product on him routinely, unwittingly exposing him to talcum powder that was contaminated with asbestos.

His lawyers also claimed that Johnson & Johnson knew for years about problems with asbestos contamination in talcum powder, but failed to warn the public about the potential risk of cancer.

The jury agreed, finding Johnson & Johnson to be 100% responsible. He was awarded $18.8 million in compensatory damages for his injuries, pain and suffering, medical bills, and more.

Johnson & Johnson has been hit by tens of thousands of lawsuits involving people who developed ovarian cancer or mesothelioma after being exposed to talcum powder.

Earlier this year, a subsidiary of the company filed for bankruptcy and offered to pay nearly $9 billion to settle around 38,000 lawsuits.

Johnson & Johnson still denies any link between talcum powder and cancer, but stopped selling the products worldwide and switched to a cornstarch-based version of baby powder instead.
