August 3, 2012 — Actos lawyers in Quebec, Canada have filed an Actos class action lawsuit. Actos (pioglitazone hydrochloride) is one of the most popular medications to treat Type 2 diabetes, and it was approved for use in Canada in 2000. Unfortunately, researchers recently discovered that taking the drug at high doses for long periods of time could significantly increase the risk of life-threatening bladder cancer.
The U.S. Food and Drug Administration (FDA) has already issued warnings and updated the label on Actos. The new label warns that using Actos for more than one year could cause a 40% increased risk of bladder cancer. Another study published this year found that Actos increased the risk of bladder cancer by 22%.
The FDA warned:
“The risk of bladder cancer increased with increasing dose and duration of pioglitazone use. Compared to never being exposed to pioglitazone, a duration of pioglitazone therapy longer than 12 months was associated with a 40% increase in risk (of bladder cancer).”
Health Canada issued similar warnings in April 2012. Health authorities in Germany and France restricted sales of Actos after European researchers warned that the drug might be linked to bladder cancer. Subsequent studies have confirmed these early warnings.
The Canadian Actos class action lawsuit was filed in the Superior Court of Montreal on behalf of Jimmy Whyte, who took Actos in 2008 and was diagnosed with bladder cancer earlier this year. The lawsuit accuses Actos’s manufacturer of failing to issue a recall or warn consumers about the risk of bladder cancer.
In the U.S., litigation is currently underway. Most American drug lawsuits are filed in a Multidistrict Litigation (MDL), which is different than a class action because each person’s lawsuit remains independent.
