$80 Million Awarded to Roundup Cancer Victim in 1st Federal Trial

March 28, 2019 — The first federal Roundup trial has ended in a jury awarding $80 million to a man who developed non-Hodgkin lymphoma after using Monsanto’s weed-killer for 25 years.

The jury also unanimously found that Monsanto failed to warn Ed Hardeman about the potential risk of cancer from using Roundup.

Hardeman was awarded $200,967 in economic damages and around $5 million in past and future non-economic damages. Monsanto was also ordered to pay him $75 million in punitive damages.

Hardeman’s attorneys presented the jury with evidence that Monsanto was aware of dozens of studies linking Roundup with cancer — and yet failed to put warning labels on the product, or conduct its own long-term research to fully investigate the potential health risks.

Lawyers also claimed that Monsanto executives secretly edited and ghost-wrote studies that found no link between Roundup and cancer, allegedly in an attempt to mislead government regulators about the health risks of using Roundup.

His case was the first federal lawsuit to go to trial out of nearly 700 similar lawsuits pending in the U.S. District Court for the Northern District of California.

It is the second Roundup trial to end in a jury awarding damages to the plaintiff. Last summer, a state-court jury awarded $289 million to a groundskeeper who developed lymphoma after using Ranger Pro.
