July 18, 2017 — The number of Risperdal lawsuits in Philadelphia doubled to 5,800 lawsuits since January and may triple by the end of the year.
Risperdal lawsuits now dominate the docket in the Philadelphia Court of Common Pleas. Judge Arnold New of the Complex Litigation Center said that the Risperdal mass-tort is the largest in the court system, according to The Legal Intelligencer.
There are up to 10 trials scheduled for later this year and early 2018, unless lawyers negotiate a settlement. The size of the litigation skyrocketed by 185% with over 3,600 new lawsuits so far in 2017.
Johnson & Johnson is also facing thousands of Risperdal lawsuits at the state and federal level in other states besides Pennsylvania.
All of the lawsuits accuse Johnson & Johnson of downplaying the risk of gynecomastia, a disfiguring side effect of Risperdal in which young boys grow female breasts that can only be removed with surgery.
Johnson & Johnson is also accused of illegally marketing Risperdal for “off-label” uses in children that were not approved by the FDA. Many of those children were boys who were diagnosed with gynecomastia. About 5% of boys on Risperdal develop gynecomastia, studies show.
The number of lawsuits continues to grow as juries continue to return sizable verdicts in favor of boys who were diagnosed with Risperdal.
For example, $70 million was awarded in July 2016 to a 5 year-old boy from Tennessee. Three other trials ended in a $2.5 million verdict in February 2015, $1.75 million in November 2015, and $500,000 in December 2015. Other cases have ended in settlements before trials.
