Texas lawyer for IVC filter side effects.April 27, 2016 — The number of IVC filter lawsuits against C.R. Bard quadrupled last last month, skyrocketing from just 93 cases in March to 383 as of April 15.

Members of this rapidly-growing litigation accuse C.R. Bard of downplaying the risk of side effects. In the last decade, dozens of deaths and hundreds of injuries have been caused by IVC filters.

The lawsuits are centralized in Arizona under U.S. District Judge David G. Campbell — Multi-District Litigation (MDL No. 2641) IN RE: Bard IVC Filters Products Liability Litigation.

The number of lawsuits against Cook Medical also increased by about 50 cases, bringing the total to 343. The lawsuits are centralized in MDL No. 2570 under Chief Judge Richard L. Young in the U.S. District Court for the Southern District of Indiana.

One recent lawsuit (PDF) was filed by plaintiff Amber Nordin, a woman who was implanted with a Bard Eclipse® IVC filer in October 2012. The device migrated and became embedded in her internal organs. She underwent surgery to remove the broken filter in January 2014. The operation was not successful and the filter remains inside her body.

According to the complaint:

“Plaintiff has suffered and will continue to suffer significant medical expenses, extreme pain and suffering, mental anguish, loss of enjoyment of life, disability, scarring and disfigurement, and other losses.”

The case was filed on January 12 in the U.S. District Court for South Dakota (Case No. 4:16-cv-04005). According to the complaint, Bard was aware of numerous events where the filter fractured, migrated, perforated the vena cava, caused blood clots, or other serious injuries. Lawyers also say Bard knew the design was defective but sold it anyway.
