$13 Million Awarded in Lowe’s Slip and Fall Lawsuit

April 21, 2016 — A jury in Las Vegas has awarded more than $16.4 million to a woman who suffered a permanent brain injury after slipping on water at Lowe’s.

The verdict includes $1.9 million in medical expenses and $14.5 million in compensation for her pain and suffering. The case is Hendrickson v. Lowe’s Home Centers LLC, Case No. A-13-687418-C.

In July 2013, Kelly Hendrickson was shopping for palm trees in the garden center of a Lowe’s home improvement store in Las Vegas. She slipped on a “slimy, wet substance” draining from the bottom of several planters and hit her head, fracturing her skull.

The 41 year-old mother with three children now has brain damage that caused her to lose her sense of smell and taste, according to the Las Vegas Review-Journal.

Lawyers for Lowe’s said the store has an “excellent safety record.” They claim employees had placed a 4-foot-tall caution cone in the area to warn about water on the floor: “She actually fell on top of the caution cone. She actually knocked it over herself.”

However, none of the security cameras recording activity in the store captured the fall itself. The store also failed to preserve video evidence of the incident.

Hendrickson’s lawyers say about 30 other people had been injured after falling in Lowe’s garden centers in Clark County in the last five years. Three of those incidents occurred at the Lowe’s where Hendrickson was injured. Her lawyers accuse the company of negligence for failing to fix the problem.
