California Woman Wins $12 Million Asbestos Talcum Powder Lawsuit

In April 2015, Colgate-Palmolive was ordered to pay $12.4 million to a woman who was diagnosed with mesothelioma after using an asbestos-contaminated talcum powder product known as “Cashmere Bouquet. The plaintiff, 73 year-old Judith Winkel, used Cashmere Bouquet nearly every day from 1961 until 1976. What is the problem?

Asbestos-contaminated talcum powder has been banned from consumer products by the FDA since 1973. Colgate-Palmolive sold Cashmere Bouquet from the late 1800s until 1995. In recent lawsuit, the company has been accused of using talcum from mines that they knew were contaminated with asbestos until 1985.

Studies Linking Cashmere Bouquet and Mesothelioma

In one study from March 1976, Dr. Arthur Rohl found that Cashmere Bouquet had between 8% and 20% asbestos. Some people who used the powder developed mesothelioma, a rare and deadly cancer that is primarily caused by inhaling microscopic fibers of asbestos. In 2014, researchers analyzed lung tissue of a woman who died of mesothelioma and concluded that her use of Cashmere Bouquet was likely to blame.

How Does Asbestos Cause Mesothelioma?

Under a microscope, asbestos looks like a bundle of fibers or needle-like splinters. When inhaled, these fibers irritate tissues and cause scarring in the lungs. Some fibers may even penetrate into the outer lining of the lungs and chest wall. These fibers can irritate the lungs and lead mesothelioma after about 20-50 years.

Asbestos in Talcum Powder Linked to Mesothelioma

In October 2014, researchers published a case report linking mesothelioma with asbestos in a commercial cosmetic talcum powder product. Researchers took tissues samples from the lungs and lymph nodes of a woman who was diagnosed with mesothelioma after using the product for years. She had no other known exposure to asbestos, but her tissues were riddled with asbestos. The researchers traced the asbestos in her tissues to Cashmere Bouquet and the mine where the talc originated.
