July 7, 2014 — Remington Arms Co. has agreed to a nationwide class action lawsuit settlement for claims that the Model 700 bolt-action hunting rifles have a defective trigger mechanism. According to the Montana Standard, the settlement could lead to a recall of millions of guns. Click here to read more.
Remington Rifle Recall
Remington is recalling the Model 700 and Model Seven bolt-action rifles with X-Mark Pro (XMP) triggers manufactured between May 1, 2006 and April 9, 2014. The problem is that some triggers have excess bonding agent within the mechanisms, which may cause the gun to fire without pulling the trigger. Click here to read more.
Remington has set up a website at http://xmprecall.remington.com where customers can check the serial number on their gun to see if it is being recalled. If your rifle is recalled, contact Remington immediately and do not use it or try to repair it. The guns should not be loaded.
Remington Rifle Class Action Lawsuit
In October 2013, the Missoulian reported that Remington was hit with at least three class action lawsuits involving defective triggers on the Model 700 rifle. The lawsuits were filed in Montana, Washington, and Missouri, but were not “certified” and some were dismissed.
Plaintiffs claim that the Model 700 series rifle can unintentionally fire due to the Walker Fire Control System, which has been used since the 1940s and is found in over 5 million firearms. The class actions allege that Remington has known for decades that the guns can fire unexpectedly.
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm, but our Products Liability Litigation Team has decided against the filing of a Remington rifle class action lawsuit. Instead, we are filing individual lawsuits on behalf of individuals and/or their family members who were injured by Remington rifles with a defective trigger.
Remington is already facing several class actions involving the Model 700 and Seven series bolt-action rifles, but these do not involve personal injury claims. In most class action lawsuits, a large number of plaintiffs have a relatively minor legal claim (such as buying a defective product).
About Class Actions
In some circumstances, class actions can offer advantages, such as aggregating a large number of claims into one representational lawsuit. The class is represented by one law firm, and one plaintiff is selected to be the “class representative.” The success or failure of the lawsuit relies on the merits of that person’s case.
Why Our Law Firm Is Filing Individual Lawsuits Opposed To a Class Action
Class actions can also have disadvantages for plaintiffs with severe injuries. Plaintiffs could be forced to accept “low-ball” settlements or higher attorney’s fees. Their case may never even be presented before a judge and jury in a court of law.
The trial attorneys at The Clark Firm, LLP, specialize in helping victims of defective products seek financial compensation and justice for their injuries. We understand that many of our clients are suffering lost wages, high medical bills, or the loss of a loved one. We help maximize each client’s recovery by filing individual lawsuits on their behalf.
