Women who use the antidepressant Prozac (fluoxetine) during pregnancy could be more likely to have a baby with a birth defect. Hundreds of lawsuits allege that the manufacturers of SSRI antidepressants have failed to warn about the risk of birth defects.
Prozac Class Action Information
Prozac (fluoxetine) is an antidepressant medication in the selective serotonin reuptake inhibitor (SSRI) class. The FDA classifies Prozac as Pregnancy Category C. This means some have shown that Prozac might cause birth defects when it is used during pregnancy, but the evidence is inconclusive.
Our lawyers are concerned because numerous studies have linked SSRI antidepressants to an increased risk of birth defects — especially heart defects. Prozac is known to pass through the placenta and influence fetal development. The FDA has specifically warned about a life-threatening lung defect called Persistent Pulmonary Hypertension of the Newborn (PPHN) from third-trimester exposure to SSRIs.
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm, but we are not filing a Prozac class action. Instead, we are filing individual lawsuits on behalf of children who were born with severe birth defects. We are concerned about studies linking SSRI antidepressants and birth defects, such as:
- Heart defects
- Atrial septal defect (ASD)
- Ventricular septal defect (VSD)
- Patent foramen ovale (PFO)
- Coarctation of the aorta
- Gastroschisis
- Omphalocele
- Hypoplastic lungs
- Persistent Pulmonary Hypertension of the Newborn (PPHN)
- Cleft palate
- And more
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Prozac Class Action
Class actions make sense in certain circumstances, such as when employees of a major corporation are systematically denied wages. However, for individual people with severe injuries, class actions can have disadvantages. Instead of having a trial attorney fight for maximum compensation on the client’s behalf, members of a class action could be forced into a blanket “low-ball settlement” with higher attorneys’ fees.
The Clark Firm, LLP provides free case evaluations for new clients. We also typically work on contingency-fee agreements. If you decide to file a lawsuit, we may be able to help you seek justice for your child’s birth defect, pain and suffering, medical expenses, permanent disability, wrongful death, and more.
