Farxiga and Diabetic Ketoacidosis

Farxiga (dapagliflozin) was the second FDA-approved member of a new class of diabetes drugs that have only been on the market since 2013. Farxiga reduces blood-sugar levels by helping the kidneys excrete glucose in urine. It works by inhibiting sodium-glucose cotransporter-2 (SGLT2), a kidney protein.

Unfortunately, Farxiga and other SGLT2 inhibitors have been linked to a possible risk of diabetic ketoacidosis. The FDA issued a Safety Communication after receiving 20 adverse event reports in the first year SGLT2 inhibitors were on the market.

In June 2015, the European Medicines Agency (EMA) said they knew of 101 cases of ketoacidosis in patients on SGLT2 inhibitors and launched their own safety investigation. The EMA also warned:

“In a number of these reports blood sugar levels were only moderately increased. These uncharacteristic blood levels could delay diagnosis and treatment. … All cases were serious and some required hospitalization.”

What is the problem?

The Clark Firm, LLP is nationally recognized as a class action law firm in Texas. However, our attorneys are not filing a Farxiga class action against AstraZeneca at this time. Instead, we are filing individual lawsuits on behalf of people who developed severe side effects, such as:

About Class Actions

The advantages of joining a class action lawsuit are clear when there are thousands of people with a similar legal claim, especially if they are seeking a relatively small payout. The lawsuit is filed on behalf of a “class representative” and an attorney argues for compensation on behalf of everyone who had the same injury.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Farxiga Class Action

Members of class actions sometimes must accept a “low-ball” settlement, high attorneys’ fees, and watch the settlement divided among thousands of other people in the lawsuit.

There are several reasons why our law firm files individual lawsuits instead of class actions for plaintiffs who were seriously injured by defective medications. We believe in holding pharmaceutical companies accountable for failing to test new medications, warn about side effects, or pull dangerous drugs off the market.

In some cases, drug-makers are hit with thousands of lawsuits from people who all had the same side effect. When this happens, it is not unusual for federal judges to centralize the litigation in one court. Like a class action, this approach improves efficiency reduces the risk of conflicting rulings in different courts.
