September 15, 2014 — A lawsuit has been filed by a man who used Fortesta (testosterone gel) and had a heart attack.
The lawsuit (PDF) was filed in the U.S. District Court for the Northern District of Illinois on September 10. Federal judges created a Multi-District Litigation (MDL) to centralize testosterone lawsuits in Chicago in June 2014.
According to a list of Pending MDLs (PDF) issued today, there are 201 lawsuits pending in the court. The litigation continues to grow at a rapid pace.
The plaintiff, William Lohan, is a resident of North Carolina who was 50 years old when he was prescribed Fortesta. He used it as directed from July 2011 through December 2012. Before taking Fortesta, he was otherwise healthy.
He suffered a heart attack on August 28, 2011. As a result, he must undergo routine medical testing, adhere to a strict diet, and take medication. He also has higher risks of additional heart attacks, stroke, and death.
Fortesta is a clear, odorless testosterone gel that has been on the market since 2010. It is manufactured by Endo Pharmaceuticals. Unfortunately, concern about the safety of Fortesta has increased after the publication of several studies.
One study, published in 2010 by the New England Journal of Medicine, had to be stopped prematurely after a large number of men suffered adverse events. In November 2013, JAMA published another study that found a 30% increased risk of heart attack, stroke, and death.
In January 2014, PLOS ONE published a study that found a doubled risk of heart attack on men over 65 years old on testosterone. Two days later, the FDA issued a Drug Safety Communication and began investigating the risk.
