April 14, 2014 — Auxilium Pharmaceuticals is facing a wrongful death lawsuit on behalf of a Louisiana man who took Testim (testosterone gel).
The lawsuit was filed by the son and daughter of John B. Peuler, a 61 year-old man who died on March 22, 2013 of a heart attack. According to the complaint, Peuler started using Testim in April 2012. He had no history of blood clots, diabetes, stroke, or other serious cardiovascular events.
Plaintiffs accuse Auxilium of engaging in an aggressive “disease awareness” marketing campaign to alert men that they might be suffering from “Low T.” Consumers were misled as to the safety and effectiveness of Testim, and as a result, many suffered life-threatening injuries.
Testosterone gel is approved for hypogonadism (low testosterone caused by a medical condition). However, recent studies have found that only half of men on testosterone replacement therapy actually had hypogonadism, and 25% received a prescription without ever having a blood test.
The U.S. Food and Drug Administration (FDA) has also launched an investigation into two studies linking testosterone gel and heart attacks. One study, published in the Journal of the American Medical Association, confirmed that testosterone could increase the risk of heart attack, stroke, and death among older men by 30%. Another study found that heart attacks were twice as common in men over 65 on testosterone vs. men who did not take testosterone.
Dozens of testosterone lawsuits have already been filed, mostly against AbbVie, Inc., the manufacturer of Androgel (testosterone gel). Testim is less popular than Angdrogel, but both drugs have been marketed for “Low T.”
