February 17, 2015 — Leadership roles have been appointed to facilitate lawsuits against the makers of Xarelto, an anticoagulant drug that has been linked to severe bleeding.
In an order (PDF) issued January 9, the Hon. Judge Eldon E. Fallon of the U.S. District Court for the Eastern District of Louisiana selected 12 attorneys to serve on the plaintiffs’ steering committee for at least one year, including two co-lead counsels.
The attorneys will be responsible for conducting and coordinating pre-trial discovery for the benefit of all plaintiffs. They will also select the trial team, examine witnesses, negotiate potential settlement agreements, speak for plaintiffs at hearings, communicate developments with plaintiffs, and other functions as needed.
One of the lead attorneys, Brian Barr, said: “Our experience with litigating the Pradaxa lawsuits (also a blood thinner) will give us a good head start in the discovery process.”
Pradaxa (dabigatran) is another blood-thinning drug that was linked to severe bleeding, partly due to its lack of a reversal agent. In May 2014, Boehringer Ingelheim settled 4,000 Pradaxa lawsuits for $650 million, or an average of $162,500 per claimant.
Like the Pradaxa litigation, Xarelto lawsuits involve bleeding injuries or deaths.
As of January 15, there were 86 Xarelto lawsuits pending in a federal Multi-District Litigation (MDL) in a federal court in Louisiana. The litigation is still in its early stages, but as it proceeds, attorneys will likely select certain cases for “bellwether” trials. The outcome of these trials will help attorneys negotiate a settlement or other resolution.
