March 6, 2014 — As part of a $16 million settlement, plaintiffs will receive an average of $40,000 for injuries caused by defective Coloplast vaginal mesh, according to Bloomberg News. The settlement resolves 400 lawsuits pending against Denmark-based Coloplast Corp.
“It appears that momentum is building for some type of global resolution as more of these vaginal-mesh cases settle,” Carl Tobias, who teaches product liability law at the University of Richmond in Virginia, told Bloomberg.
The settlement would wrap up federal lawsuits consolidated in a Multi-District Litigation (MDL No. 2387) pending in West Virginia, where thousands of additional lawsuits are pending as lawyers engage in settlement negotiations with C.R. Bard, American Medical Systems, Boston Scientific, Johnson & Johnson, and Cook Medical.
The most common and consistently-reported problem with vaginal mesh is erosion through the vaginal wall. The complication must be treated with surgery because it can cause chronic pain, infection, and interfere with sexual intercourse. Unfortunately, because vaginal mesh is designed to be a permanent implant, doctors may be unable to completely remove it from a woman’s body.
