April 28, 2015 — Boston Scientific will pay $119 million to settle 2,970 lawsuits involving vaginal mesh and will report a loss in the first quarter, according to the Wall Street Journal.
Regulatory filings indicate that Boston Scientific has been hit with more than 25,000 lawsuits involving vaginal mesh products. About 16,000 of those were centralized in a federal Multi-District Litigation (MDL) in West Virginia.
Several manufacturers of vaginal mesh have been hit with over 75,000 federal lawsuits and settlements are inching forward. U.S. District Judge Joseph Goodwin, who oversees the massive litigation, has urged manufacturers to come to the table or face “potentially billions of dollars in verdicts.”
Boston Scientific has won two trials but lost several more. Last year, a jury in Texas awarded $73 million to a woman who was injured by Obtryx mesh, but the award was slashed to $34 million in October.
In November, a jury in Miami ordered the company to pay $26.7 million to four women who were injured by the company’s Pinnacle mesh implant.
All of the lawsuits accuse Boston Scientific of failing to adequately design or test vaginal mesh products before marketing them to women with organ prolapse and urinary incontinence. In 2011, the FDA warned that vaginal mesh can erode through the vagina and cause severe, debilitating complications that may be impossible to cure.
