August 9, 2016 — A case involving a man who had a heart attack after using AndroGel has been chosen for the first trial over the dangers of testosterone therapy in July 2017.
U.S. District Judge Matthew F. Kennelly issued an order (PDF) on August 3 naming eight AndroGel lawsuits for the first “bellwether” trials, 4 involving heart attacks and 4 involving venous blood clot injuries like deep vein thrombosis (DVT) and pulmonary embolism.
The first case to go before a jury will be a lawsuit filed by Jeffrey Konrad, a 55 year-old man from Tennessee with a history of heart disease. He started taking AndroGel 1% in May 2010 to treat diagnosed hypogonadism. In July 2010, he suffered a heart attack at the age of 49 — Case No. 1:15-cv-00966.
Konrad had a heart attack just after a small study in the New England Journal of Medicine found an increased rate of heart attacks among men over 65 with limited mobility who used testosterone gel.
AbbVie, the manufacturer of AndroGel, is accused of promoting it for age-related “Low T” and failing to warn about side effects.
After all eight trials, Judge Kennelly will schedule a second set of trials for other testosterone products like Testim, Axiron, and Androderm. The cases will be chosen from over 5,500 lawsuits pending in Multi-District Litigation (MDL No. 2545) in the Northern District of Illinois.
