April 15, 2016 — Over 5,250 lawsuits have been filed by men who suffered cardiovascular events after using testosterone replacement products like Androgel, according to an update from the U.S. Judicial Panel on Multidistrict Litigation.
The lawsuits have been centralized for pre-trial proceedings in Multidistrict Litigation (MDL No. 2545) under District Judge Matthew F. Kennelly in the Northern District of Illinois.
Last November, Judge Kennelly dismissed all claims after finding that failure-to-warn claims involving “generic” testosterone products were preempted by federal law. After plaintiffs appealed the ruling, Judge Kennelly issued an order clarifying that the lawsuits can proceed for claims involving fraudulent off-label marketing.
All of the lawsuits involve men who say drug-makers failed to warn about the risk of heart attacks, strokes, blood clots, and death from testosterone. The MDL process is designed to improve convenience and efficiency, reduce duplicative discovery, and avoid conflicting rulings from different judges.
Six lawsuits are set for trial between April and November 2017. These so-called “bellwether” trials help lawyers determine how a jury might respond to evidence and expert testimony. The outcome can also influence settlement negotiations, especially when compensation is awarded.
One recent lawsuit (PDF) was filed by a 55 year-old man who started using AndroGel in June 2005 to boost his testosterone levels. In July 2006, he suffered a pulmonary embolism (blood clot in the lungs). The lawsuit was filed in January 2016 in federal court in Pennsylvania (Case No. 1:16-cv-02087).
The size of the litigation has been grown rapidly in the last few years. Several studies have found evidence linking testosterone and cardiovascular events. In January 2015, a study published in Pharmacotherapy found that first-time testosterone users might be 40% more likely to suffer a heart attack.
