Texas Homeowners File Lawsuit Against Gerard Roofing Technologies

In February 2013, Willow Greene Homeowners Association (HOA) filed a lawsuit accusing Gerard Roofing Technologies, Inc., of selling a defective roof that leaked and failing to fix the problem despite providing a lifetime warranty.

The problems began back in 2005, when Willow Greene allegedly paid nearly $1 million to install Gerard’s Granite Ridge stone-coated steel interlocking shingles on a 25-building, 172-unit condominium complex.

Some time later, a number of leaks popped up throughout the complex. The contractor Willow Greene hired to install the roof spent “countless hours” chasing leaks at the chimneys, siding, skylights, and more.

Eventually, they determined that the roofing material itself was leaking — meaning they had a much bigger problem than previously thought. According to the complaint:

“Even if installed correctly in accordance with Gerard’s installation manual and procedures, as was done at Willow Greene, the Granite Ridge roofing system leaks. As a result, Willow Greene has useless roofs that are leaking throughout the condominium complex, and has incurred significant damages to both the interiors and exteriors of its condominium units.”

Willow Greene bought the roof with a lifetime warranty, which supposedly guaranteed that the roof was free from manufacturing defects and weatherproof.

Despite submitting warranty claims, numerous phone calls, and e-mails to Gerard, it took another 7 months before a representative was sent out. Willow Greene said the representative only took a brief look at the roof before denying the warranty claim.

Willow Greene contacted an attorney and filed a lawsuit the U.S. District Court for the Eastern District of Texas. According to the lawsuit:

“There were design, manufacture, marketing, distributing and selling defects in the Granite Ridge roofing system at the time it left possession of defendants that were the producing cause of plaintiff’s damages. The Granite Ridge roofing system was defective when sold and failed to perform as promised and intended.”
