Texas Vaginal Mesh LawyerSeptember 10, 2012 — The judge presiding over Avaulta vaginal mesh lawsuits against C.R. Bard has scheduled a second set of bellwether trials for June 24, 2013, according to a Discovery Scheduling Order dated August 23, 2012. The first set of bellwether trials has already been scheduled to begin February 2012. U.S. District Judge Joseph R. Goodwin currently presides over several Multidistrict Litigations (MDLs) against several vaginal mesh manufacturers.

 

There are already hundreds of vaginal mesh lawsuits pending against various manufacturers, including C.R. Bard. Most of these lawsuits make similar allegations — namely, that vaginal mesh is defective and can cause severe injuries.

Thousands of women have reported severe injuries, and the FDA has published several warnings. The mesh can erode into the vagina, perforate internal organs (intestines, bladder, blood vessels, etc), become severely infected, cause nerve damage, scarring, and other serious conditions. Unfortunately, even multiple surgeries may not correct all complications. Many women suffer permanent scarring and chronic pelvic pain.

The first vaginal mesh lawsuit to go to trial was awarded $5.5 million by a California state court jury. The plaintiff, Christine Scott, suffered a perforated colon caused by C.R. Bard’s Avaulta vaginal mesh. She required eight surgeries and still suffers from incontinence and pain during sexual intercourse.

Lawsuits against other manufacturers are also proceeding. Vaginal mesh MDLs have been established against C.R. Bard, American Medical Systems, Boston Scientific, Ethicon/Gynecare (Johnson & Johnson), and Coloplast. There are already hundreds of lawsuits in these litigations, and lawsuits continue to be filed.
